1. In Short

Separation Tracker is built so that we do not hold your information.

2. Where Your Information Lives

2.1 On your device only

Evidence entries and attachments; photographs and documents; captured messages; daily logs and wellbeing observations; communication and handover records; calendar entries and custody events; financial records and receipts; children's details as you record them; statements you record; witness details, case information and court dates; your settings and jurisdiction.

Access is protected by a PIN you set, and by biometric authentication if you enable it.

Because this information is on your device, its safety depends on your device. If your phone is lost, damaged, reset or stolen and you have not made a backup, the information may not be recoverable.

2.2 Backups you create

You can create an encrypted backup file. The file contains a complete copy of your records and attachments, encrypted with a key derived from a passphrase you choose. We never receive the file and cannot decrypt it. If you lose the passphrase, the backup cannot be opened by anyone, including us. You choose where the file is stored; once it leaves the app, its security depends on wherever you put it.

2.3 What we actually hold

Subscription status, received through our subscription management provider. We never see or store your card details. Support correspondence, if you email us. That is the complete list.

2.4 What we do not collect

No analytics, usage tracking, telemetry or crash reporting. No advertising identifiers and no cross-app tracking. No location data transmitted to us — location you attach to an entry stays on your device. No content of your records. No artificial intelligence processing of any kind.

Note: if you use the app's option to look up an address from a location, that location is sent to your device operating system's mapping service to return an address. This is an operating system service, not ours.

3. Your Responsibility To Keep Backups

We cannot restore your data. We do not have it. We strongly recommend creating a backup at least weekly, and before any court date. The App shows how long it has been since your last backup.

4. Third Parties

Apple App Store and Google Play process subscription purchases and billing; they receive payment details, which we never see. RevenueCat manages subscription entitlements and receives subscription status and an anonymous identifier.

No other third party receives anything. There is no AI provider, no analytics provider, no advertising network and no data broker involved in this application.

5. International Transfers

Because your records stay on your device, there is no international transfer of your case information. Our subscription management provider may process limited status information outside your country of residence. Where required by law we rely on appropriate safeguards for that transfer.

6. How Long Information Is Kept

On your device: until you delete it, or delete the App.

Deleted entries: removed from your records and hidden from lists and exports, but retained on your device so the record's history remains complete. You can include deleted entries in an export if you choose. A factory reset permanently removes everything.

Your backups: retained wherever you stored them, under your control.

Subscription records we hold: as required for accounting and tax purposes, generally 5 years. Support correspondence: 5 years, then deleted.

7. Record Integrity

The date and time an entry was created is recorded automatically and cannot be altered. You can correct an entry, but corrections are recorded: the App shows when an entry was created, when it was edited, and what changed. Exports include creation dates and an appendix listing any corrections. Imported content cannot be edited; only its title, category and tags can be changed.

This is deliberate. A record that can be silently changed is worth less than one that shows its own history.

8. CHILDREN'S INFORMATION

The App is for adults aged 18 and over. Records in a family law matter frequently concern children. We treat this as the most sensitive information the App handles, and it stays on your device.

We are designed to minimise it. When you add a child, the name field defaults to "Child 1", "Child 2" and so on — you do not need to enter a real name. We do not ask for or store a child's date of birth. You can produce a de-identified export in which children's names are replaced with "Child A", "Child B" and so on, for sharing with a mediator, school or support worker.

You are responsible for ensuring you have lawful authority to record information about a child or any other person.

9. Sensitive Information

Records in the App may include information that is sensitive information under Australian privacy law and special category data under UK and EU data protection law, including health information, information about family violence, and information about criminal allegations. This information stays on your device. We do not receive, process or hold it.

Where the UK GDPR or the EU GDPR applies to information we do hold — subscription status and support correspondence — our legal bases are performance of a contract, our legitimate interests in supporting and securing the service, and compliance with legal obligations.

10. Your Rights

Depending on where you live you may have rights to access, correct, delete, restrict or object to processing of your personal information, to data portability, to withdraw consent, and to complain to a regulator.

In practice your records are already in your possession and under your control on your own device, and can be exported from the App at any time. For the limited information we hold, email support@evidencetrackerglobal.com. We will respond within 30 days. There is no charge.

11. Data Breaches

Because we hold so little, the information exposed in any breach of our systems would be limited to subscription status and support correspondence. If a breach occurs that is likely to cause serious harm, we will notify affected individuals and the relevant regulator as required.

A breach of your device, or of a backup file you have stored, is outside our systems and our knowledge. Protect your device passcode and your backup passphrase accordingly.

12. Family Law Confidentiality

Family law proceedings are subject to statutory confidentiality obligations and restrictions on publication. In Australia, Part XIVB of the Family Law Act 1975 (Cth) restricts communicating an account of proceedings to the public, and section 114Q creates an offence. Section 114S confirms that private communications, including to family, friends, or for use in connected proceedings, are not communications to the public. Using this app privately to organise your own records is not publication.

Similar restrictions apply in New Zealand, in England and Wales, and in Ireland, where family proceedings are heard in camera.

You remain responsible for ensuring that anything you export, share or publish complies with court orders, suppression and non-publication orders, undertakings, and the law of your jurisdiction. We do not monitor your compliance.

13. Lawful Collection

Laws about recording conversations, capturing messages, photography and surveillance differ significantly between countries and, in Australia, between states and territories. Conduct lawful in one place may be an offence in another. You are solely responsible for ensuring that everything you place in the App has been lawfully obtained and may lawfully be used.

14. Availability And Jurisdictions

The App is offered in Australia, New Zealand, the United Kingdom and Ireland.

Australia: we handle personal information in accordance with the Privacy Act 1988 (Cth) and apply the Australian Privacy Principles in full.

New Zealand: the Privacy Act 2020 and the Information Privacy Principles apply.

United Kingdom and Ireland: the UK GDPR, the EU GDPR and the Data Protection Act 2018 (Ireland) may apply to the limited information we hold.

15. Legal Requests

We may disclose information we hold where required by law, a court order, a warrant, a subpoena or another lawful request. Because your records are on your device and not on our servers, the information we can disclose is limited to subscription status and support correspondence. Where permitted, we will take reasonable steps to notify you first.

16. Not Legal Advice

Evidence Tracker Global Pty Ltd is not a law firm and does not provide legal advice. Using Separation Tracker does not create a solicitor-client relationship. We do not determine whether your records are admissible, complete or sufficient for any proceeding.

17. Changes

We may update this policy. Where changes are material we will notify you in the App before they take effect.

18. Complaints

Contact us first at support@evidencetrackerglobal.com. We will acknowledge within 7 days and respond substantively within 30 days.

If you are not satisfied you may complain to: the Office of the Australian Information Commissioner (oaic.gov.au); the Office of the Privacy Commissioner, New Zealand (privacy.org.nz); the Information Commissioner's Office, United Kingdom (ico.org.uk); or the Data Protection Commission, Ireland (dataprotection.ie).
